El 30 de octubre de 2023, el ni\u00f1o Dami\u00e1n N., de 10 a\u00f1os, se golpe\u00f3 la cabeza mientras jugaba futbol dentro de la Escuela Primaria \u2018Eucario Zavala \u00c1lvarez\u2019, ubicada en Mexicali.<\/div>\n

El incidente ocurri\u00f3 alrededor de las 13:00 h, previo al inicio de clases. Posterior al golpe, el menor present\u00f3 dolor de cabeza.<\/div>\n

De acuerdo con Valeria N., hija del maestro Esteban, el alumno notific\u00f3 el golpe y malestares hasta las 15:00 h.<\/div>\n

El docente, seg\u00fan el relato, avis\u00f3 de inmediato a los padres de Dami\u00e1n y activ\u00f3 el seguro m\u00e9dico de la escuela, con lo que el menor fue llevado a una cl\u00ednica.<\/div>\n

M\u00e9dicos de la cl\u00ednica valoraron al menor y lo dieron de alta a pesar de presentar v\u00f3mito.<\/div>\n

La madrugada del 31 de octubre el ni\u00f1o perdi\u00f3 el conocimiento y tras ser reingresado a la cl\u00ednica fue diagnosticado con muerte cerebral.<\/div>\n

Autoridades de Baja California abrieron una investigaci\u00f3n por la muerte del alumno Dami\u00e1n.<\/div>\n

La Fiscal\u00eda General del Estado (FGE) se\u00f1al\u00f3 al maestro Esteban del delito de omisi\u00f3n de auxilio, por no actuar con diligencia.<\/div>\n

Acus\u00f3 que el docente no acompa\u00f1\u00f3 al menor a la cl\u00ednica ni se asegur\u00f3 de que recibiera atenci\u00f3n m\u00e9dica inmediata, lo que contribuy\u00f3 a su muerte.<\/div>\n<\/div>\n

Durante la audiencia se lleg\u00f3 a una resoluci\u00f3n que permiti\u00f3 al maestro abandonar el recinto judicial sin medidas restrictivas inmediatas.
